Tribunal's reasoningAt this public preliminary hearing on 17 January 2022, Employment Judge Sweeney dealt with a complaint by Trevor Farley against Sunderland City Council. The complaint of unlawful deduction of wages under section 23 ERA 1996 was presented outside the statutory time limit. The tribunal was not satisfied that it had not been reasonably practicable for the complaint to be presented in time, so that claim was dismissed.
The tribunal struck out a number of Equality Act 2010 complaints under rule 37(1)(a) on the basis that they had no reasonable prospect of success. These were direct discrimination on grounds of age, sex and disability, indirect sex discrimination, harassment related to age, sex and disability, and victimisation.
The decision did not affect the complaints of indirect disability discrimination, indirect age discrimination, and failure to make reasonable adjustments, which were identified as continuing to a final hearing. No monetary remedy was recorded in this preliminary hearing decision.
