Tribunal's reasoningThe claimant, Ms F Williams, brought claims of unfair dismissal and detriment on grounds of part-time working status against London Capital Credit Union. The hearing was before Employment Judge George in Watford on 4 February 2022, with the claimant appearing in person and the respondent represented by Mr R Skuplak, consultant.
The tribunal held that the unfair dismissal claim was not presented within three months of the effective date of termination, and that it had been reasonably practicable to present it in time. On that basis the tribunal found it did not have jurisdiction to consider the claim and dismissed it.
The tribunal made a similar jurisdictional finding in relation to the Part-time Workers (Prevention of Less Favourable Treatment) Regulations 2000 claim. It found that the detriment claim was not presented within three months of the date of the act complained of, and that it was not just and equitable to extend time under reg. 8. That claim was therefore also dismissed. No monetary award was made.
