The tribunal found that the respondent's actions were not because of the manifestation of the claimant's beliefs itself, but because it reasonably objected to the inappropriate manifestation of those beliefs and the claimant's subsequent conduct when the respondent tried to address the matter. It found that interference with the claimant's expression was proportionate and justified in light of the respondent's responsibility for students' pastoral care.
For indirect discrimination, the tribunal found a PCP concerning employees not being publicly associated with social media posts incompatible with the school's ethos and capable of undermining public confidence in a position of trust. It found the claimant's group disadvantage case unclear and, in any event, held that the PCP was a proportionate means of achieving a legitimate aim. The tribunal dismissed all claims.
