Tribunal's reasoningAt the preliminary hearing on 7 September 2021, Employment Judge Manley allowed the claimant's application to amend the claim to add three race-related matters. These were item 2 on the Scott Schedule, clarified as an allegation of harassment related to race arising from Mr San providing false information about KS5 assessment to Mr Jones; a new allegation of harassment related to race in the way a meeting between Mr Jones and the claimant on 12 February 2020 was conducted; and item 9 on the Scott Schedule, clarified as allegations of harassment related to race and direct race discrimination arising from an email sent by Mr Jones on 14 July 2020 threatening an investigation into a matter on 29 June 2020.
The tribunal refused amendment for item 8, described as a comparison between the claimant's treatment during sick leave commencing in February 2020 and Mr Watts and said to be victimisation and direct discrimination. It also refused item 10(b), described as alleged harsh treatment at a grievance meeting on 3 September 2020 by Mr Singer and said to be victimisation and disability discrimination, and item 13, the dismissal on 30 April 2021 said to be unfair dismissal.
The judge declined to decide at that stage whether any allegations or arguments had little reasonable prospect of success, and no deposit was ordered. The claim was listed for a further and final open preliminary hearing by CVP on 18 January 2022.
