The tribunal recorded that the claimant's claims had already stood dismissed for non-compliance with the unless order made by Employment Judge R Lewis on 21 December 2021, under rule 38 of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013. It held that it was not in the interests of justice to set aside that dismissal.
The tribunal also considered the claims in the alternative and found that the claimant's complaints of discrimination on the grounds of age, pregnancy or maternity, and disability had been presented outside the time limit in s.123 Equality Act 2010.
