Tribunal's reasoningMr Rana worked as a Security Officer at Sutton Place. After the UK Government sanctioned the property's owner, Alisher Usmanov, and froze his assets, HR told Mr Rana to continue working as normal. The tribunal found that he worked throughout March, April, May and June 2022 and received payslips but was not paid. His employment ended by redundancy on 30 June 2022. The respondent entered no response and did not attend the hearing.
The redundancy claim was presented within the statutory six-month time limit. The unpaid wages, notice pay and holiday pay claims were outside the usual three-month limit, which the tribunal said expired on 30 September 2022. Mr Rana had been repeatedly assured that he would be paid and did not learn that he could bring a tribunal claim until around October 2022. He contacted ACAS on 28 October, received his Early Conciliation Certificate on 9 November and presented his claim on 23 November 2022. The tribunal found that timely presentation had not been reasonably practicable and that he subsequently acted within a reasonable period. It therefore had jurisdiction over all four complaints.
The tribunal upheld all four claims, finding that the sums were due and had not been paid. It ordered payment of £27,081.21, comprising £10,864.81 statutory redundancy pay, £1,111.32 holiday pay, £5,447.40 net notice pay for three months and £9,657.68 gross wage arrears for March–June 2022. Paragraph 18 gives a different wage arrears figure of £9,657.00; the operative order uses £9,657.68, which matches the stated total.
