Key findings
Tribunal's reasoningThis was a preliminary hearing on whether the claimant was disabled for the purposes of the Equality Act 2010. The claimant alleged disability discrimination arising from workplace mask-wearing requirements, but the substantive allegations were not adjudicated in this judgment.
The tribunal found that the claimant had long-term physical impairments of asthma/lung impairment and rosacea. It accepted evidence of reduced lung function, long-standing asthma medication, breathing difficulty when symptomatic, and difficulty wearing a face covering, and concluded that the physical impairments had a substantial adverse effect on normal day-to-day activities at the material time.
The tribunal also found that the claimant had a long-term and recurring mental impairment of depression/anxiety. It accepted evidence that the condition substantially affected normal day-to-day activities and that, without medication and treatment, the effects would have been materially worse. The claimant was therefore found to be disabled at the material time by reason of both physical and mental impairments.
Claims and outcomes
1 finding recorded| Claim type | Issue or finding | Outcome | Protected characteristic | Award |
|---|---|---|---|---|
| Disability discrimination | Preliminary hearing only. The tribunal determined that the claimant was a disabled person at the material time; it did not determine the substantive disability discrimination allegations. Paragraph 81 appears to contain inconsistent 2018 dates, but the judgment elsewhere repeatedly identifies the material period as 1 April 2021 to 18 October/November 2021. | Other | Disability | — |

How we got this data
Case essentials (reference, date, judge, venue, country, claim categories) are extracted from the structured metadata gov.uk publishes alongside each decision. Parties and monetary figures are extracted from the judgment PDF text. Key findings and per-claim outcomes require a second extraction pass that is not yet complete for this case — until then, the primary source linked above is the authoritative record.
