Tribunal's reasoningThe tribunal found that there was no redundancy situation in December 2021 and no fair reason for the claimant's dismissal. It found that the claimant had been redeployed after her original role ended, that there was no consultation process or vacancy process consistent with redundancy, and that the dismissal was unfair.
Several disability discrimination complaints succeeded. The tribunal found that the claimant was treated less favourably in connection with the proposed business support executive role, the handling of her role and grievance, and the decision to dismiss her, and that some treatment was because of disability or sickness absence arising from disability.
