Key findings
Tribunal's reasoningThe claimant brought complaints of direct race discrimination, harassment related to race, victimisation and constructive dismissal, relying on being black Ghanaian. The respondent applied for strike out, or alternatively deposit orders, on the basis that specified allegations had little or no reasonable prospects of success. The tribunal considered the claimant's pleaded allegations, the prior case management process, the contemporaneous documents and submissions from both parties.
The tribunal found that direct discrimination complaint 7, concerning an asserted requirement to meet the Deputy CEO while grieving, had no reasonable prospects because the contemporaneous documents showed the claimant was not required to attend and had the opportunity to postpone. The same reasoning led to victimisation complaint 7 being struck out. Direct discrimination complaints 9 and 10, and victimisation complaints 9 and 10, were found to have no reasonable prospects, but were not struck out because of their proximity to the resignation and their connection to other issues proceeding to a final hearing; instead, deposits were ordered.
The tribunal found that direct discrimination complaint 2 had little reasonable prospects of success because the basis of inference was weak and only articulated at the hearing, and ordered a deposit. It declined to order deposits for several other allegations despite noting weaknesses, having regard to their apparent importance or connection to other complaints. The claimant was ordered to pay five deposits of £30, totalling £150, as a condition of continuing with the specified allegations.
Claims and outcomes
4 findings recorded| Claim type | Issue or finding | Outcome | Protected characteristic | Award |
|---|---|---|---|---|
| Race discrimination | Preliminary hearing on strike out/deposit, not final determination of liability. Direct discrimination complaint 7 was struck out as having no reasonable prospects. Direct discrimination complaints 2, 9 and 10 were allowed to proceed only if deposits of £30 each were paid. The respondent's strike out/deposit application was otherwise refused for the remaining direct discrimination allegations, with complaint 5 noted as subject to an outstanding amendment application. | Other | Race | — |
| Harassment | Preliminary hearing only. The respondent sought strike out or deposit in relation to harassment complaint 2, but no strike out or deposit was ordered. Harassment complaint 1 was not the subject of the application. | Other | Race | — |
| Victimisation | Preliminary hearing only. Victimisation complaint 7 was struck out as having no reasonable prospects. Victimisation complaints 9 and 10 were allowed to proceed only if deposits of £30 each were paid. The respondent's strike out/deposit application was otherwise refused. | Other | — | — |
| Constructive dismissal | Preliminary hearing only. The constructive dismissal complaint relied on the alleged discrimination as repudiatory breach and was affected by the same considerations, but it was not finally determined and no separate strike out or deposit order was made. | Other | — | — |

How we got this data
Case essentials (reference, date, judge, venue, country, claim categories) are extracted from the structured metadata gov.uk publishes alongside each decision. Parties and monetary figures are extracted from the judgment PDF text. Key findings and per-claim outcomes require a second extraction pass that is not yet complete for this case — until then, the primary source linked above is the authoritative record.
