Tribunal's reasoningBernadeta Pradzynska brought a claim against Hotel in the Skye Ltd alleging that she had been unlawfully deprived of wages. The respondent did not lodge an ET3 and did not appear at the CVP hearing on 2 March 2023. The claimant gave brief evidence with Polish translation support, and the Employment Judge found her to be an honest and credible witness.
The tribunal found that the claimant worked as a housekeeper and cleaner at the Flodigarry Hotel from 12 August 2022 to 21 September 2022, paid at £10.50 per hour. Her hours varied with demand, and she kept a diary and used the respondent's laptop to log on and off at the start and end of shifts. The tribunal accepted that she had been paid for 151 hours on 20 September 2022, but also found that she had worked a further 269 hours and 35 minutes for which she had not been paid. It also found that she had not been given holidays during employment and had received no holiday pay.
The tribunal awarded £2,830.59 gross for unpaid wages and £533.02 gross for unpaid annual leave, making a total award of £3,363.61. The claim for tips was rejected because there was too much uncertainty about whether the respondent operated a tips distribution system and, in any event, the claimant could not prove the amount allegedly due.
