The Claimant later sought to reopen the claims, saying that the Respondent had breached the settlement agreement in relation to tax deductions. The Tribunal treated the correspondence as a reconsideration application and found that the Claimant had not identified grounds on which the COT3 settlement could be set aside, such as misrepresentation, fraud or undue influence.
The Tribunal concluded that there was no reasonable prospect of the dismissal judgment being varied or revoked, and rejected the reconsideration application under Rule 70(2).
